Furniture distribution is damaged and lost and you have to bear it
Mr. Xu had planned to buy a new set of furniture for his home before the New Year, hoping to welcome the holiday with a fresh and modern look. However, the furniture he received turned out to be damaged upon delivery. When he tried to return it, the furniture factory refused, stating that the goods had already been sold and that they couldn’t accept returns unless there was an issue with the product itself.

He was so pleased with the quality that he immediately paid for it and arranged for the manufacturer to ship it to his home. After waiting a week, the furniture finally arrived. But when he picked it up, he discovered that it was damaged—apparently due to an accident involving the transport vehicle in Jiangxi.
The damage made it impossible for Mr. Xu to accept the furniture. He contacted the factory to request a return, but the company denied the request, claiming that once the goods were shipped, the responsibility for any damage fell on the buyer. According to the Contract Law, if there is no specific agreement between the seller and the buyer, the risk of loss or damage during transit falls on the buyer once the contract is signed. This means that even though the furniture was damaged during transportation, Mr. Xu was legally responsible for the loss.
This situation left Mr. Xu frustrated, as he had invested a significant amount of money in the furniture, only to have it arrive in poor condition. He felt that the rules were unfair, especially since the damage occurred while the goods were in transit. Although the law clearly states that the buyer bears the risk after the contract is established, many people might argue that the seller should also share some responsibility, especially if the logistics process was not properly managed.
In the end, Mr. Xu was left with a damaged piece of furniture and no clear path for resolution. He now faces the difficult choice of either accepting the loss or trying to find another way to resolve the issue through negotiation or legal means.
